Bangladesh Election News: Sheikh Hasina sued for extortion

Former prime minister and Awami League (AL) chief Sheikh Hasina was sued on April 09, 2007 in connection with an extortion of Tk 3 crore.

 

Tajul Islam Farook, chairman of Westmont Power Company, filed the case with Tejgaon police station under the non-bailable sections of the penal code.

 

In the case Tajul brought allegations against Hasina of extortion and abuse of power in 1998, when she was the prime minister.

 

Hasina, who is now on a visit to the US, recently made some comments there criticising the non-party caretaker government and the Election Commission for 'delaying' the next general election on 'different pretexts'. She is supposed to return home on April 26 or 27.

 

The case was filed at , but Tejgaon police officials refused to comment on it. If the prima facie case is proven to be well-founded through investigation, an arrest warrant will be issued against the former prime minister, according to the law.

 

The case was filed under sections 385, 386, 387 and 109 of the penal code. In accordance with the sections, a person can be sentenced to five years to life in jail if the court finds him or her guilty.

 

According to the constitution a person is not eligible for contesting in elections, if she/he is convicted of a crime and sentenced to at least two years in prison on charges of moral turpitude, unless five years have passed since his or her release from jail.

 

Following the launch of the ongoing crackdown on suspected corrupt politicians on February 4 by the caretaker government, speculations have been mounting that there might be a change in the leadership of major political parties.

Ninth Parliamentary Election of Bangladesh not likely before end-2008

The expatriate Bangladesh community of as many as 70 lakh remains out of the voter list, let alone participate in the national election, is indicative of an exclusionary nature of our elective democracy. In light of this, it's heartening to note that the Election Commission has decided to fill the void by including the overseas Bangladeshis in the national electoral roll thereby giving them their long-denied right to vote.

 

With the decision for a database to be created for voters with their photographs, extending the facility to the overseas Bangladeshis cannot be a difficult exercise. All that the government needs ensuring is to have the expatriates registered with Bangladesh embassies or missions abroad. They can either vote through the missions, or preferably via the internet where the counting can be done instantaneously.

 

It is worth recalling that the Bangladeshis living abroad had launched a movement demanding right to franchise in 2001 election. Even though the then chief election commission M A Sayed took up the matter, he had to abandon the project citing complications. So how we get around the 'complications' and the pitfalls that occurred at that time are the jobs cut out for the interim government.

 

The pressing nature of the issue can be appreciated from three angles; first and foremost, remittances from overseas Bangladeshis being the topmost foreign exchange earner and their contribution to the economy a dire necessity, their inaccessibility to voting right is simply unfair and unjust. Let's not forget, we are vociferously keen on attracting investment from non-resident Bangladeshis (NRBs).

 

Overarching imperative is that no citizen of Bangladesh, whether he or she is living at home or abroad, can be denied his or her constitutional right to vote; and it is as ludicrous as it is untenable that for some technical or administrative inadequacies he or she should be denied participation in the election. Last but not least, could we not just follow the procedures of other countries in settling the matter?

Bangladesh Election: EC to complete electoral reforms by July

The Election Commission (EC) intends to complete the task of electoral reforms by July, Election Commissioner Brig Gen (retd) M Sakhawat Hossain said.

 

The EC on February 18 started reviewing the existing electoral laws to bring in massive electoral reforms without setting any timeframe to complete the task. The Awami League and BNP delegations at separate meetings with the EC had however demanded the parliamentary election by June and July respectively.

 

The election commissioner said, "We are emphasising on electoral reforms. We hope the entire task for the reforms would be completed by July."

 

"We want to reform the electoral system in such a way so that a free and fair election can be held," he added.

 

About the preparation of voter list, the election commissioner said the EC is planning for preparing electoral rolls with photographs. He however did not specify any time to begin the task of preparing the list.

 

Sources close to the EC said the EC is unlikely to begin preparing the voter list before completing electoral reforms. The EC does not have any tentative timeframe for holding the stalled ninth parliamentary election and it has put emphasis on the reform agenda.

 

About the electoral reforms, the election commissioner said the EC is making it mandatory for political parties to register with the EC. "An unregistered political party will not be allowed to contest parliamentary elections," he added.

 

A government bureaucrat will be barred from participating in the polls before three years of his or her retirement from the service have elapsed, said Sakhawat.

Roadmap to the Bangladesh Parliamentary election 2007 to be disclosed in 2-3 weeks

The Election Commission (EC) has plans to introduce voter identification cards for the next parliamentary election while the chief election commissioner (CEC) said the commission's roadmap for the poll will be disclosed within two or three weeks.

 

In response to a High Court (HC) ruling suspending all polls for three months since Jan 29, the date of the ruling, the EC will inform a HC division bench today about its plans to introduce voter ID cards.

 

CEC ATM Shamsul Huda told a BNP delegation that the EC plans to inform the nation about its roadmap for the next parliamentary election, BNP Vice-chairman MK Anwar, who led the four-member delegation, told reporters after their meeting with the CEC and other two election commissioners.

 

The BNP delegation asked the EC to initiate steps for holding the stalled ninth parliamentary election within six months since the formation of the caretaker government on January 12.

 

"Our expectation is that the next parliamentary election will be held by July 11. The chief election commissioner informed us that they will inform the nation in the next two or three weeks about a roadmap for holding the parliamentary election," MK Anwar said.

 

The BNP delegation met the CEC three days after a high-powered Awami League delegation had met him demanding holding of the stalled ninth parliamentary election by June.

 

Jatiya Party led by HM Ershad is scheduled to meet the CEC on March 5 and the Communist Party of Bangladesh will meet him the next day, sources said.

 

Emerging from the hour long meeting, the BNP delegation chief said holding the parliamentary election as early as possible is within the EC's jurisdiction.

 

"We hope the reconstituted Election Commission will be able to present a free and fair election. We will extend all cooperation for a free and fair election," MK Anwar, also a former minister, said.

 

He said the CEC informed them about the EC's initiatives for electoral reforms.

Corrupt Politicians of Bangladesh barred from Contesting in Election

The government has barred corrupt people from participating in any parliamentary or local government election by amending the rules of Emergency Power Ordinance (EPO).

 

Any person, convicted of corruption by a trial court, will be disqualified from contesting in any election until adjudication of his or her appeal against the verdict and no convicted person will ever be able to hold any job related to the government, according to the amendments to the rules.

 

The amendments also dictate that if a person is identified by the authorities as possessing or occupying properties which does not conform to his or her legal source of income, the government can order the person to submit a wealth statement to the authorities in person. If he or she does not do so or deliberately avoids contact with the authorities for more than 72 hours after notification, the government can confiscate his or her moveable and immovable properties by obtaining a magistrate's order.

 

The government can sell such confiscated properties through open auctions with court's approval and will submit the earned money to the public exchequer.

 

The caretaker government promulgated the rules of EPO on January 25. The amendments were brought to some of the clauses of EPO bringing a new dimension to it.
